The recently renewed law (Article 14.1 of the Municipal code) defines Foreclosure as "The reversion or transfer of title to a property to a lender, mortgagee, or beneficiary of a deed of trust, or an agent thereof, in full or partial satisfaction of a defaulted obligation."

As California is a Title Theory state, it is understood that the title is actually held by the benificiary of the deed of trust, so when the property goes back to the benificiary at the trustee sale how can the title be said to have reverted or transfered? At the very least this law would seem to omit properties purchased at trustee sale by someone other than a lender.

Wow. I would have never guessed that people can stoop that low to defraud the government when facing foreclosure. However, I think that when people are desperate to make ends meet then they can find themselves doing things that they never expected. I think the law in LA that does protect renters is still a good one as most of the time the lease agreements may be legitimate. Renters need to have some form of protection in the event that the homeowner forecloses.

I heard on the news that last year alone, almost 20 million houses were foreclosed. This is becoming a very serious problem. Some homeowners are successful in fighting off foreclosure, like a couple who played hard ball and foreclosed their own bank. But cases like this are extremely rare. There is even this one guy who took possession of a foreclosed house by invoking a law that was amended during the Wild West.
